Sun World International LLC es titular de diversas solicitudes y registros de obtenciones vegetales  internacionales sobre una serie de variedades de fruta de hueso cultivadas en España, entre las cuales se identifican las siguientes:

• Suplumthirtyeight (ciruela que pertenece a la serie BLACK GIANT®)

• Suplumfortyone (ciruela de pulpa roja de maduración muy precoz de la serie BLACK DIAMOND®)

• Sunectwentyone (nectarina de la serie SUPER STAR®)

Estas variedades de fruta de hueso se comercializan con sus respectivas marcas registradas, cuyas características son las siguientes:

BLACK GIANT®: ciruelas de piel negra y pulpa amarilla, de gran calibre

BLACK DIAMOND®: ciruelas de piel negra y pulpa roja

SUPER STAR®: nectarinas con excelentes calidades gustativas.

Sun World se protege activamente sus derechos registrales sobre obtenciones vegetales y otros derechos de propiedad industrial. Las tres variedades de fruta de hueso arriba indicadas son objeto de protección por la ley española y europea sobre obtenciones vegetales.

Sun World recuerda a todos los agricultores, viveros y comerciantes españoles que dichas variedades no pueden multiplicarse, distribuirse o plantarse de manera legítima sin suscribir un contrato de licencia con Sun World. Sun World se reserva el derecho a ejercitar las acciones judiciales contempladas en la ley contra todos los que multipliquen, planten, produzcan o vendan árboles o fruta de dichas variedades sin la preceptiva licencia.

Sun World reaffirms its intellectual property rights on its stonefruit varieties

Sun World International LLC is the owner of the international patents on several stonefruit varieties grown in Spain, among which:

• Suplumthirtyeight (a plum of the BLACK GIANT® series)

• Suplumfortyone (a very early ripening red-fleshed plum of the BLACK DIAMOND® series)

• Sunectwentyone (a nectarine of the SUPER STAR® series)

These stonefruit varieties are sold under their respective registered trademarks, whose characteristics are the following:

BLACK GIANT®: extremely large plums with black skin and yellow flesh

BLACK DIAMOND®: plums with black skin and red flesh

SUPER STAR®: nectarines with excellent eating qualities.

Sun World is actively committed to protecting its own plant patents and IP rights. These three stonefruit varieties are protected under the Spanish and European plant patent law.

Sun World reminds all Spanish growers, nurseries and distributors that the above varieties cannot be propagated, marketed or planted legally without a license agreement with Sun World. Anyone who propagates, plants, produces or sells trees or fruit of these varieties without a license will be prosecuted to the fullest extent permitted by law.
